Trademark24 provides trademark assistance, administrative support, and general trademark-related information. Information provided by Trademark24 does not constitute legal advice, legal opinion, financial advice, tax advice, or professional legal representation.

Trademark24 may make use of independent third-party practicing attorneys, agents, or specialists where required to assist with trademark applications and related processes in accordance with the applicable trademark laws and regulations, including the South African Trade Marks Act 194 of 1993.

While we strive to provide accurate and useful information, Trademark24 makes no guarantee that any information, recommendation, or service is suitable for every individual circumstance or jurisdiction.

1. No Guarantee of Registration or Success

Trademark applications are subject to examination, objections, opposition proceedings, and regulatory requirements that are outside the control of Trademark24.

Accordingly:

Trademark24 cannot guarantee the successful registration of any trademark;
Trademark24 cannot guarantee the outcome of any trademark application, objection, opposition, renewal, or related process;
The customer acknowledges that trademark registration outcomes are inherently uncertain.

Trademark24, its representatives, contractors, and associated parties shall not be held liable for unsuccessful applications, refusals, objections, delays, or disputes arising from trademark processes.

2. Nature of Services

Trademark24 is not a law firm and does not provide formal legal representation.

Trademark24 provides:

administrative trademark services,
trademark filing assistance,
general trademark information,
and informed non-legal guidance based on experience.

Trademark24 representatives do not:

appear in court,
represent clients in litigation,
provide formal legal opinions,
or act as attorneys of record unless specifically handled through an independent qualified attorney.

Where legal proceedings or specialist legal assistance become necessary, it remains the customer’s responsibility to appoint a qualified attorney or legal professional.

3. Independent Professional Advice

The information published on this website or communicated by Trademark24 should not be regarded as professional legal, financial, accounting, or tax advice.

Users are encouraged to seek independent professional advice before making legal or commercial decisions relating to trademarks, intellectual property, or related matters.

4. Searches & Risk Assessments

Trademark searches and assessments are conducted using available records and databases. While every effort is made to identify potential conflicts, no search can guarantee that all conflicting or similar trademarks will be identified.

Search results, opinions, and risk assessments are based on available information at the time of the search and should not be interpreted as guarantees of registrability or enforceability.

5. Refund Policy

Due to the immediate commencement of work once payment is received:

cancellations must be submitted in writing within 2 hours of payment confirmation;
approved refunds may be subject to a 15% administration and banking fee deduction.

After this period, no refunds will be issued unless otherwise agreed in writing.

Trademark24 reserves the right to issue company credit in certain circumstances at its sole discretion.

Government fees, filing fees, courier fees, search fees, and third-party costs may be non-refundable.

Trademark24 shall not be liable for costs associated with objections, oppositions, disputes, refusals, rebranding, or additional legal proceedings.

6. Customer Responsibilities

Customers are responsible for:

providing complete and accurate information,
reviewing all submitted documents and applications,
monitoring correspondence and communications,
and following up if expected information or updates are not received within a reasonable timeframe.

Trademark24 shall not be held responsible for delays or issues caused by incorrect, incomplete, or misleading information supplied by customers or third parties.

7. Timeframes & Delays

Trademark registration timeframes are estimates only and may vary significantly due to backlogs, government processing delays, examination procedures, objections, or third-party actions.

Trademark24 cannot guarantee processing times or registration dates.

8. Third-Party Services

Trademark24 may make use of third-party service providers, including:

attorneys,
trademark agents,
courier companies,
digital signature providers,
hosting providers,
and government platforms.

Trademark24 shall not be held liable for delays, failures, interruptions, or errors caused by third-party providers beyond its reasonable control.

9. Courier & Delivery Services

Where courier services are requested, Trademark24 may use third-party courier providers including DHL, FedEx, or equivalent providers.

Courier costs and handling fees may apply and must be paid in advance unless otherwise agreed.

Delivery timeframes are estimates only and are subject to the courier provider’s operations and service availability.

10. Confidentiality

Trademark24 will treat customer information as confidential and may sign reasonable non-disclosure or confidentiality agreements upon request.

However, customers acknowledge that information may need to be shared with relevant third parties, government authorities, attorneys, or service providers where necessary to perform requested services.

11. Intellectual Property & Website Content

All website content, forms, text, graphics, questionnaires, documents, and materials belonging to Trademark24 are protected by copyright and intellectual property laws.

No material may be reproduced, copied, distributed, or republished without prior written permission.

Trademark24 may use images, references, or content from third-party sources where applicable rights remain with their respective owners.

Links to third-party websites are provided for convenience only.

Trademark24 does not endorse and accepts no responsibility for:

third-party content,
accuracy of information,
privacy practices,

13. Electronic Signatures

Trademark24 may use accredited electronic signature and digital authentication services in accordance with the South African Electronic Communications and Transactions Act, 2002 (ECT Act).

14. Force Majeure

Trademark24 shall not be liable for delays or failure to perform services due to circumstances beyond its reasonable control, including but not limited to:

internet outages,
hosting failures,
government delays,
natural disasters,
cyber incidents,
labor disputes,
war,
civil unrest,
pandemics,
or failures of third-party suppliers or service providers.
15. Amendments to Terms

Trademark24 reserves the right to update or amend these Terms & Conditions at any time without prior notice.

Updated terms may apply to existing and future customers where reasonably necessary for operational, legal, or compliance purposes.

16. Acceptance of Terms

By instructing, engaging, or using Trademark24 services — whether verbally, electronically, in writing, or online — the customer confirms acceptance of these Terms & Conditions and acknowledges that they are legally binding.

17. Right to Refuse or Terminate Services

Trademark24 reserves the right to refuse, suspend, revoke, or terminate services or agreements at its discretion and without prior notice where necessary.
